Ontario Postnuptial Agreements: Create Clarity After Marriage

Like a prenup, a postnup can address property, assets, debts, and spousal support, but it is created later in the relationship once circumstances, finances, or priorities have evolved. In Ontario, postnuptial agreements are governed under Section 52 of the Family Law Act and are treated as legally binding marriage contracts when properly prepared and signed.

Our agreements run through a clear, collaborative process, as part of our family law services. Whether your financial situation has changed since the wedding, a business was started during the marriage, or you simply never signed a prenup but wanted to, an agreement can help.

Top 3 Reasons Why People Get Postnups

Many couples decide to put an agreement in place after major life or financial changes occur during the marriage. The process is often less about conflict and more about creating transparency and certainty around important financial decisions. The courts won’t allow a separation agreement masked as a postnuptial agreement. Which is why sometimes an uncontested separation agreements might be the better choice for your situation.

1

One spouse starts or grows a business during the marriage and wants to clearly define how that business would be treated if the relationship ever ended.

2

A significant inheritance, investment, or family asset enters the marriage and the couple wants to document how it should be handled moving forward, including tracing inheritance assets even if used for shared family property.

3

The spouses want to clarify responsibility for debts, financial obligations, or future support expectations in a way that feels fair and predictable for their specific circumstance, not based off of generic Ontario family law rules.

Are Postnuptial Agreements Enforceable?

Yes, when they meet the legal requirements set out under the Family Law Act. The agreement must be in writing, signed by both spouses, and properly witnessed. At common-law, full financial disclosure and independent legal advice are also strongly recommended to help strengthen enforceability.

The main difference between a prenuptial agreement and a postnuptial is simply timing. Prenups are signed before marriage, while postnuptials are signed afterward. Both are treated as marriage contracts under Ontario law.

Courts place significant importance on whether both spouses understood the agreement fully and entered into it voluntarily. That is why having independent legal advice and a thoughtful, non rushed process matters so much.

These agreements are commonly used to revisit or update older agreements after major life changes like children, new business ventures, changes in income, or large property purchases.

One important limitation: an agreement cannot predetermine parenting arrangements or custody issues involving children. Courts will always prioritize the best interests of the child at the time decisions are made.

How Matrimonial Home is treated in a Postnuptial Agreement

The matrimonial home is one of the most important and most misunderstood parts of Ontario family law. Even when only one spouse owns the home or paid the down payment, both spouses may still have important legal rights connected to it during the marriage.

An agreement cannot completely remove the legal protections surrounding the matrimonial home under Ontario law, but it can still address important financial details involving the property.

Why Choose Angrove Law?

FAQs

How is a postnuptial agreement different from a prenuptial agreement?

The main difference is timing. A prenup is signed before marriage, while a postnuptial is signed afterward. Both agreements can address many of the same financial and property issues and carry the same legal weight when properly prepared and signed.

How much does a postnuptial agreement cost in Ontario?

Angrove Law offers flat fee pricing of $2,195 for agreements with no retainer and no hourly billing. Independent legal advice for the other spouse is arranged separately through another Ontario lawyer.

Is a postnuptial agreement enforceable in Ontario?

Yes, when it meets the requirements of the Family Law Act. It must be in writing, signed by both parties, and witnessed. Both spouses should have independent legal advice, and there must be full financial disclosure. Ontario courts evaluate agreements carefully to ensure neither party was pressured and both understood what they were signing.

Can we replace a prenuptial agreement with a postnuptial?

Yes. If your circumstances have changed significantly since your prenuptial agreement was signed. For example, the birth of children, a major change in income, starting a business, or receiving an inheritance, a postnuptial can update, supplement, or supersede your original prenup.

Can a postnuptial agreement be overturned in Ontario?

In some situations, yes. Courts can set aside marriage contracts where there was inadequate financial disclosure, significant unfairness, pressure, or concerns that one spouse did not fully understand the agreement at the time it was signed.

Does both spouses need a lawyer for a postnuptial agreement?

Technically no, but independent legal advice for both spouses is strongly recommended and significantly strengthens enforceability. Angrove Law represents one spouse and can help connect the other spouse with an Ontario lawyer for independent legal advice.

When You Should Consider an Agreement

Starting a Business

Protect a newly formed company, partnership, or professional practice from being treated as divisible marital property if the marriage ends.

Receiving an Inheritance

Document that an inheritance remains separate property, and is not to be equalized, even if it has been or will be commingled with joint funds.

Major Asset Acquisition

Purchased a property, investment portfolio, or valuable asset after the wedding? An agreement documents ownership and intended treatment.

Debt Protection

One spouse has taken on significant debt for a business or personal reason. Your agreement can clarify that the other spouse is not responsible.

Blended Families

Protect financial assets intended for children from a previous relationship while bringing clarity to the financial structure of the new marriage.

Updating Your Prenup

If you already have a prenuptial agreement and your circumstances have changed significantly, a postnuptial agreement can update or supersede the original document.

Improving Communication

Some couples use the agreement process as a structured way to have important financial conversations, with a lawyer’s guidance, that they did not have before the wedding.

Simply Want Certainty

Even without a specific trigger, your agreement gives both spouses documented financial clarity and peace of mind about the future.

What Makes Your Agreement Enforceable?

Written, Signed & Witnessed

Your agreement must be in writing, signed by both spouses, and witnessed. Verbal agreements about financial arrangements are not binding.

Full Financial Disclosure

Both spouses must disclose all assets, debts, and income. Incomplete or misleading disclosure is grounds for a court to set the agreement aside.

Independent Legal Advice

Both spouses should have their own lawyer review the agreement before signing. We represent one spouse and help connect the other with a trusted Ontario ILA lawyer.

No Duress or Pressure

Courts scrutinize agreements carefully. Both parties must sign freely, with adequate time to review and seek legal advice.

Fair Terms

Clauses that are grossly unfair at the time of separation, particularly around spousal support, can be overridden by an Ontario court.

Proper Execution

Correct signing procedures, dates, and witness signatures are legally required. Procedural errors can expose the agreement to future challenge.

Angrove Law builds every enforceability requirement into our process from the initial free consultation to your final signing.
