ILA Before Signing a Family Law Agreement
Independent legal advice, often called ILA, means having your own lawyer review an agreement with you before you sign it. Your lawyer explains what the agreement means, how it may affect your rights, and whether there are any terms you should think more carefully about before moving forward. Most importantly, your ILA lawyer represents only you.
Angrove Law provides independent legal advice for family law agreements across Ontario through a fully virtual process designed to feel clear, efficient, and easy to navigate at an affordable price.
When Should You Get Independent Legal Advice?
Independent legal advice is not always legally required, but it is strongly recommended for most family law agreements in Ontario and can play an important role in enforceability later.
Marriage contracts and cohabitation agreements are significantly stronger when both parties receive independent legal advice before signing. Without it, especially in the age of AI, the validity of your agreement in the future could be at risk.
Separation agreements involving property, support, or parenting issues should generally be reviewed by separate lawyers for each party.
If you feel uncertain about what you are signing or want to fully understand the legal consequences before agreeing, ILA is always worthwhile.
What to Expect During Your ILA Meeting With Angrove Law
Your ILA meeting is a private one on one conversation with your lawyer. Before the meeting, we review the agreement and supporting financial disclosure documents carefully so we understand the context of the arrangement.
During the meeting, we walk through the agreement with you in plain language, explain how the terms may affect you legally and financially, and answer any questions you may have along the way.
If there are terms that raise concerns or revisions that should be considered, we can help communicate those concerns back to the drafting lawyer before anything is signed.
Once the review is complete, we provide a Certificate of Independent Legal Advice confirming that you received proper legal advice before signing the agreement.
It is important to remember that the lawyer representing the other party cannot provide legal advice to you, even if they explain parts of the agreement. Their role is to protect the other party’s interests. Your ILA lawyer is there to protect yours.

Why Choose Angrove Law for Independent Legal Advice?
FAQs on Independent Legal Advice in Ontario
What is independent legal advice (ILA)?
Independent legal advice means having your own lawyer review an agreement with you before you sign it. Your lawyer explains what the agreement means, how it may affect your rights, and whether there are any terms you should think carefully about before moving forward.
When is ILA required for family law agreements in Ontario?
ILA is strongly recommended for marriage contracts, cohabitation agreements, separation agreements, and other family law documents in Ontario. Independent legal advice (where each party has their own lawyer review the agreement before signing) isn’t a legal requirement for these agreements in Ontario, but it’s one of the most practical things you can do to make sure the agreement holds up. Courts look closely at whether both parties understood what they were signing, and having your own lawyer on record makes that question much easier to answer.
Who can give independent legal advice in Ontario?
ILA must be provided by a licensed Ontario lawyer who is acting exclusively for you, not the lawyer who drafted the agreement, and not a lawyer who has advised any other party in the matter. At Angrove Law, we often act as the ILA lawyer for parties whose partners used a different firm to draft the document.
How much does independent legal advice cost in Ontario?
Angrove Law provides ILA for family law documents at $300/hour with no retainer. Most ILA engagements take 2.5 hours. This accounts for our preparation, a legal advice meeting, and a signing meeting. If you have complex arrangements or one that is not drafted properly, it may take longer. The initial 15-minute consultation is always free, and we provide a time estimate before you commit.
What is a Certificate of Independent Legal Advice?
A Certificate of Independent Legal Advice is a document confirming that a lawyer reviewed the agreement with you, explained the legal implications, and confirmed that you signed voluntarily and with full understanding of the terms.
Can the same lawyer provide ILA for both parties?
No. A lawyer can only provide independent legal advice to one party. A single lawyer cannot give ILA to both parties; that would be a conflict of interest and would not provide you with the protections you are looking for by getting ILA. Each party must have their own lawyer for the ILA to be considered genuinely independent.
What family law agreements does Angrove Law provide ILA for?
Our family law lawyer regularly provide ILA for marriage contracts, prenuptial agreements, cohabitation agreements, separation agreements, post nuptial agreements, and other domestic contracts across Ontario. We also have our corporate lawyers provide independent legal advice for business contracts.
Questions to Ask Yourself Before Your ILA Session
Before meeting with your lawyer for independent legal advice, it can help to take a little time to think through any questions or concerns you may have about the agreement. These are some of the topics we commonly walk through together during a family law ILA session.
Unclear Terms
Are there any words, phrases, or clauses in the agreement that you do not understand? Write them down before the meeting.
Legislative References
Does the agreement reference legislation or regulations, like the Family Law Act or Divorce Act, that you are not familiar with?
Completeness
Does the agreement reflect the full reality of your relationship, assets, and financial situation as you understand it?
Financial Disclosure
Do you fully understand the financial documents that were disclosed to create this agreement? Are there assets or debts that seem missing or understated?
Pressure
Do you feel pressured to sign by your partner, family, or external circumstances like a wedding date or closing date on a property?
Support Terms
Do you understand what the agreement says about spousal support, both what it provides and what rights you may be waiving?
Future Changes
Does the agreement address what happens if circumstances change significantly: new children, job loss, or a major asset acquisition?
Your Comfort Level
Do you feel genuinely comfortable signing this agreement? Your ILA lawyer is there to make sure you do or to help you understand why you should not.
If you’ve been asked to sign a family law agreement and need ILA, book a free 15-minute consultation and we’ll explain exactly what the process involves and how long it will take.
Why Proper Independent Legal Advice Matters for Enforceability
Courts Look at the ILA Record
When a party seeks to set aside a family law agreement, courts examine whether both parties had independent legal advice. The absence of ILA is often the first argument raised.
Financial Disclosure Must Be Complete
ILA is only meaningful if both parties have been fully transparent about their assets, debts, and income. Your ILA lawyer will review the financial disclosure as part of the process.
Timing Matters
Getting ILA at the last minute, right before a wedding or property closing, can itself raise questions about duress. Earlier is better.
Your Lawyer Is Exclusively Yours
The drafting lawyer represents the other party. Only your ILA lawyer is 100% on your side. Do not rely on the other party’s lawyer for advice.
Ask Every Question
Your ILA session is your opportunity to ask every question you have, no matter how basic it seems. That is what the session is for.
The Certificate Makes It Official
The Certificate of ILA we issue is the formal record of your legal advice session. Keep it with your agreement.
Angrove Law’s ILA service gives you the understanding and documentation you need to sign with confidence or the clarity to ask for changes before you do.
